Overview

This one day course covers the practical application of the Mental Capacity Act 2005, for adults deemed unable to make their own decisions, due to a lack of capacity. It covers both the principle of what is meant by “Best Interests” and the process by which this can be determined, in line with the Code Of Practice and reference to relevant case law. The use of the Best Interests Checklist, Best Interests Meetings and the role of the IMCA will be explored, incorporating both theory and practical case study exercises.

Description

The Mental Capacity Act 2005 and accompanying Code of Practice requires decision makers to follow the “decision maker’s checklist” in order to determine as far as practicable what decision the adult would make, if they still had capacity.

This workshop session is designed to explore how to work in a way, which is compliant with the legal framework. The roles and responsibilities of advocates and representatives will be covered. The use of the balance sheet and the practice of holding Best interest Decision meetings will also be covered.

By the end of the session attendees will have gained knowledge and skills that will enable them to demonstrate an understanding of the limits of powers and duties to take decisions for adults without capacity. The session will also cover writing up Best Interest Decisions to present at the Court of Protection, where necessary
